regarding this ongoing election, first that they elections shall be held

must point out the fact that Mr.Dabee has ensured only about 500
resource members are allowed to vote even when historically, different
members paid their membership fees at different times including on the day
of election so as to be able to be in good standing and vote as it's
their right. <br><br>The ongoing election under Mr. Dabee supervision
unconstitutionally set a deadline for resource members to register to
vote and those resource members who paid their membership fees later
after the said deadline even today, they are in good standing will
never be able to vote in an election process whose dates of elections
have changed multiple times <br></div><div><br></div><div>I have made it
a point to document all these irregularities and state of confusion
with the ongoing election process. I would also like to point out to you
as NOMCOM Chair, that the ongoing election is unconstitutional and I
have attached herein an email I sent to Mr.Dabee about the same for your
reference and consideration. I pointed out the need to seek members' motions for any deviations to the Bylaws and the need for court order for any deviation to the Bylaws endorsed by both Resource members and the receiver. </div><div><br></div><div>It is stated in the election guideline under section 3.8 that Mr.Dabee the "3.8 As AFRINIC currently has no directors in office, the Receiver shall,
for all intents and purposes, be deemed to exercise all the powers of
the Board, as conferred by the Bylaws, for the purposes of this
election. Accordingly, both the NomCom and ElecCom shall operate under
such written guidance of the Receiver"</div><div><br></div><div><img src="cid:ii_mf817t0f2" alt="Screenshot 2025-09-06 at 11.55.08.png" width="578" height="67"><br><br></div><div>Has NOMCOM raised these issues before the receiver? </div><div><br></div><div>Has NOMCOM questioned the receiver about these deviations considering the fact that the receiver was appointed to reconstitute the board as per bylaw as he himself announced in February if where the constitution can not be implemented, seek resource members guidance through a motion as per the bylaws and also court mandate?</div><div><br></div><div><div dir="ltr" class="gmail_signature"><div dir="ltr"><div dir="ltr"><div dir="ltr"><div>Cheers,</div><div><b>Noah Maina</b></div></div></div></div></div></div><br></div></div></div></div></div></div><br></div><br><div class="gmail_quote"><div dir="ltr" class="gmail_attr">On Fri, Sep 5, 2025 at 4:36 PM AFRINIC Communication via Members-Discuss <<a href="mailto:members-discuss@afrinic.net" target="_blank">members-discuss@afrinic.net</a>> wrote:<br></div><blockquote class="gmail_quote" style="margin:0px 0px 0px 0.8ex;border-left:1px solid rgb(204,204,204);padding-left:1ex"><div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px">Dear Esteemed Members,</div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px"><br></div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px">The NomCom would like to express its sincere appreciation to every member of the community for your strong response and interest in the recent call for candidates for the AFRINIC Board of Directors.</div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px"><br></div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px"><b>The call for candidates officially closed on Tuesday, 2nd September, 2025 with 29 valid submissions received.</b></div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px"><br></div><div dir="ltr" style="font-family:"times new roman","new york",times,serif;font-size:13px">Since the opening of the call, the NomCom has been carefully evaluating all submissions.
